The functionalities used on the website are operated on the basis of the user’s consent pursuant to Art. 6(1) sentence 1 lit. a GDPR or on the basis of beam’s legitimate interest pursuant to Art. 6(1) sentence 1 lit. f GDPR. beam’s legitimate interest lies in ensuring an appropriate design and the continuous optimisation of the website. The purpose of data processing and the categories of personal data are described within the respective functionality.
5.1 Google Analytics
The website uses Google Analytics, a reach analysis service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (hereinafter referred to as “Google”). Google Analytics uses cookies that enable an analysis of the user’s use of the website. In doing so, personal data (IP address) is transferred to Google servers outside the EU and stored there. To ensure the protection of users’ personal data, beam has activated so-called “IP anonymisation” for the website. As a result, IP addresses of users within the EU are processed by Google only in shortened form – i.e., anonymised. Only in exceptional cases is the full IP address transferred to Google servers outside the EU and shortened there. The transmitted IP address is not merged with other Google data.
On behalf of beam, Google uses the collected data to evaluate users’ activities on the website, compile reports on website activity and provide beam with other services related to website use and internet use.
Users can prevent the collection and use of their data by Google by downloading and installing the following browser plugin: tools.google.com/dlpage/gaoptout.

Google Tag Manager makes it possible to manage website tags via an interface. Google Tag Manager itself is a cookie-less domain and does not collect any personal data. It triggers other tags, which in turn may collect personal data. Google Tag Manager itself does not access this data. If deactivation has been carried out at domain or cookie level, this remains in place for all tracking tags implemented with Google Tag Manager. Google’s Privacy Policy is available at policies.google.com/privacy.
5.3 Google Maps
The website uses the Google Maps mapping service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (hereinafter referred to as “Google”). This allows interactive maps to be displayed directly on the website and enables the user to conveniently use the map function.
In this context, it is necessary to store the user’s IP address. The information obtained in this way is generally transferred to a Google server outside the EU and stored there. This takes place regardless of whether the user is logged into their Google account or not. Google stores the user data as usage profiles and uses it for advertising, market research and/or needs-based design of the website.
If the user is logged into their Google account, the data is assigned to the account. This assignment can be prevented by the user logging out of their Google account beforehand.

If users are logged into Facebook, the visit is assigned to the relevant account. If users interact with the plugin, the relevant information is transmitted directly from the browser to Facebook and stored there. It cannot be ruled out that every user of the website is recorded by Facebook on the basis of their IP address and the URL accessed, even if they do not click the plugin and are not logged into a Facebook account.

The contest is in no way connected to Facebook or Instagram and is in no way sponsored, supported, or organized by Facebook or Instagram.
The recipient of the information provided by the participant is the contest organizer and not Facebook or Instagram.
By participating in the contest, the participant releases Facebook and Instagram from any liability.
3. Participants
Participation in the contest is free of charge. All natural persons aged 18 and over (the age at the time of participation is decisive) with permanent residence in Germany, Austria, or Switzerland are eligible to participate. Employees of the contest organizer, their relatives, and employees of participating companies and their relatives are excluded from participating in the contest. The contest organizer reserves the right to request proof of age.
Participation in the contest requires an account on Facebook or Instagram. The terms and conditions of these platforms are therefore a prerequisite and legal basis for participation in the contest.
Participation in the contest is only possible under the terms and conditions of participation listed here and under the specific contest post on the social media platforms specified in more detail above. By participating in the contest, the participant accepts these terms and conditions of participation.
Participation is not dependent on the purchase of goods or the use of a service from the contest organizer. The purchase or use of a service does not increase the chances of winning.
4. Exclusion from the contest
The contest organizer reserves the right to exclude persons from the contest in the event of non-compliance with the contest conditions or a violation of these terms and conditions of participation. This also includes persons who use unauthorized aids or otherwise gain advantages through manipulation. If the requirements for exclusion are met, the prize can be subsequently revoked or prizes already delivered can be reclaimed.
5. Implementation and handling
Participation in the contest is only possible within the period listed in the specific contest post. The participant may only play once. Multiple participation, e.g., under a different name, is not permitted. There is no entitlement to participation in the contest.
The specific description including the possible prize as well as the course of the contest can be found in the corresponding contest post on the Facebook and/or Instagram page specifically designated at the beginning.
a. Facebook:
In contests in which images or videos must be submitted for participation, the jury of the contest organizer is entitled—provided the corresponding posting provides for this—to make a pre-selection from all images, videos, and posts of the participants. The jury consists of employees of the social media agency and employees from the digital marketing department of the contest organizer. The contest organizer is also entitled to publish the aforementioned pre-selection in a second posting for voting on the social media profiles of beam GmbH. In the case of user voting, the image or video with the most likes at the time the contest expires wins. In contests in which participation takes place purely by commenting on the contest post or by liking the post, the winners are drawn at random. If only one comment proves to be correct, the winner will be determined by random principle exclusively from the participants with the correct comment. As soon as the winner has been determined by the contest organizer, the respective person will be informed of the prize via Facebook private message. In addition, a post may be published on the beam Facebook page mentioning the winner and using the images or videos submitted by the winner. The winner expressly agrees to this form of publication. The images or videos of the other participants may also be used by the contest organizer for further posts that are directly related to this contest. With the Facebook private message, the winner is requested to send a private message via Facebook to the contest organizer to confirm the prize within 14 days of the prize notification. If a winner does not report within this period, the prize is forfeited. The claim to the prize cannot be transferred to third parties. A new determination will not take place.
b. Instagram comment contests:
Participation in the contest takes place by commenting on the contest post. For successful participation, the contest questions specified in the post must be answered and/or other requirements must be met. Winners are drawn at random. If only one answer proves to be correct, the winner will be determined by random principle exclusively from the participants with the correct answer.
As soon as the winner has been determined by the contest organizer, the respective person will be informed of the prize via private Instagram message. In addition, the winner will be tagged in a story on the beam Instagram channel (instagram.com/beam_dampfsauger/) using the Instagram username. The winner expressly agrees to this form of publication. With the prize notification, the winner is requested to send a private message via Instagram to the contest organizer to confirm the prize within 14 days after the prize notification. If a winner does not report within this period, the prize is forfeited. The claim to the prize cannot be transferred to third parties. A new determination will not take place.
c. Instagram image contests:
Participation in the contest takes place by posting an image on the Instagram channel of the respective participant using the respective contest hashtag and/or by tagging @beam_dampfsauger. For this, the participant’s profile must be public. The winner will be selected by the jury of the contest organizer.
As soon as the winner has been determined by the contest organizer, the respective person will be informed of the prize via private Instagram message. In addition, the winning image will be published on the beam Instagram channel (instagram.com/beam_dampfsauger/) in a reposting or a story using the Instagram username. The winner expressly agrees to this form of publication. With the prize notification, the winner is requested to send a private message via Instagram to the contest organizer to confirm the prize within 14 days of the prize notification. If a winner does not report within this period, the prize is forfeited. The claim to the prize cannot be transferred to third parties. A new determination will not take place.
d. Instagram Story contests:
Participation in the contest takes place by answering the contest question asked in the story or fulfilling the requirements mentioned in the story. Winners will be determined by random principle from among the correct answers.
As soon as the winner has been determined by the contest organizer, the respective person will be informed of the prize via private Instagram message. In addition, the answer and the name of the winner (Instagram username) will be published in a story on the beam Instagram channel (instagram.com/beam_dampfsauger/).
6. Granting of rights of use
The participant guarantees that they are the owner of the necessary rights to the photos uploaded or linked as part of the contest participation. If the participant is not the sole author or rights holder, they expressly declare that they have the rights required for participation in the contest.
The participant grants the contest organizer the following simple, temporally and spatially unlimited but non-exclusive rights of use to the photo used by them:
• the right to store the photo on a server;
• the right to make the photo accessible to the public in whole or in part via the Facebook and/or Instagram accounts listed above;
The contest organizer will identify the author in a suitable manner when using the image, insofar as this is feasible taking into account the specific form of use.
7. Liability and indemnification
If the participant uploads photos, the participant guarantees that they will not send any content whose provision, publication, or use violates applicable law or the rights of third parties.
The participant indemnifies the contest organizer against claims of third parties of any kind resulting from the illegality of photos used by the participant. The indemnification obligation also includes the obligation to fully indemnify the contest organizer against legal defense costs (e.g., court and lawyer costs).
8. Determination of the winner
After the end of the contest, the prizes will be raffled among all eligible participants.
The claim to the prize expires within two months if the transmission of a prize to a winner is not possible and the reasons for the unsuccessful transmission are the responsibility of the winner. In this case, a new winner will be determined.
The transmission of non-cash prizes is only free of charge within Germany for a single delivery attempt. Otherwise, the winner must bear transport costs and other charges (customs duties, taxes, etc.). Incorrect information during contest participation or incompletely transmitted delivery addresses will lead to exclusion from the prize award.
The claim to the prize cannot be assigned or transferred. The prize cannot be paid out, supplemented, or changed. Should the prize, for whatever reason, not be able to be provided, the contest organizer reserves the right to award an equivalent replacement prize.
9. Premature termination of the contest
The contest organizer is entitled to prematurely cancel, suspend, or change the contest if unforeseen circumstances occur outside the control of the contest organizer that make the implementation unreasonable for the contest organizer. This includes in particular, but not exclusively, the unauthorized intervention of third parties, technical problems with hardware or software that are outside the power of the contest organizer, as well as legal violations that are directly related to the implementation of the contest, in particular manipulative intervention in the course of the contest or the continued commission of personal or data protection rights violations to the detriment of other participants and/or the contest organizer.
10. Liability of the contest organizer
The contest organizer is only liable if and insofar as the contest organizer, its legal representatives, executive employees, staff, or other vicarious agents are guilty of intent or gross negligence. This does not affect any claims for compensation due to injury to life, limb, or essential contractual obligations.
11. Data processing during the contest
The contest organizer collects and stores the following data as part of the contest: salutation, name, email address, address, country. The data will only be used to carry out and process the contest within the framework of the legal regulations, in particular to determine and notify the winner, and will be deleted after the end of the contest. The data will not be passed on to third parties. In particular, the corresponding data will not be passed on for advertising purposes. The data will only be passed on to third parties without the participant’s consent if the contest organizer is legally obliged to do so. The participant can revoke their consent to the use of their personal data by the contest organizer at any time with effect for the future and demand that their data be deleted immediately. Such a revocation should be sent to: datenschutz@beam.de. In all other respects, the provisions of the contest organizer’s privacy policy apply, which can be accessed at https://www.dampfsauger-beam.de/en/privacy-policy. If the data is revoked during the event period, the participant will be excluded from participation.
12. Severability clause
Legal recourse is excluded. Any general terms and conditions of the participant shall not apply. The law of the Federal Republic of Germany applies. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Should individual provisions of the terms and conditions of participation be or become invalid, the validity of the remaining terms and conditions of participation shall remain unaffected.
